Nota Simple

Definition

A nota simple is an official summary document from the Spanish Land Registry (Registro de la Propiedad) that shows the current ownership details of a property, any mortgages or charges secured against it, any restrictions on the title, and the cadastral reference. It is the most important due diligence document for any property purchase in Spain.

Why It Matters

Reviewing a nota simple before committing to any property purchase is essential. It reveals who legally owns the property, whether there are any debts or mortgages secured against it, and whether there are any restrictions on ownership or use.

Where It Appears in the Buying Process

A nota simple should be obtained by your lawyer at the due diligence stage before signing any binding contract. For off-plan purchases it is obtained for the land on which the development will be built.
