Bank Guarantee
Definition
A bank guarantee (aval bancario) is a legal commitment from a Spanish bank to refund a buyer's stage payments if the developer fails to complete the property within the agreed timeframe or becomes insolvent. It is a mandatory legal requirement for all off-plan property purchases in Spain under Ley 57/1968 (updated 2015). Bank guarantees should be obtained for each stage payment individually.
Why It Matters
Bank guarantees are the primary financial protection for off-plan buyers in Spain. Without valid bank guarantees, a buyer's stage payments are at risk if the developer encounters financial difficulties. Verifying that a guarantee is in place before making each payment is a non-negotiable step.
Where It Appears in the Buying Process
Bank guarantees apply throughout the construction phase, covering each stage payment from the Private Purchase Contract deposit through to any payments made before completion. They expire on completion when ownership transfers via the title deed.
